Website Terms of Use

Last updated: October 28, 2026

These Website Terms of Use (“Terms”) describe the conditions for access to and use of NaiaHaulani.com, including its website content and free downloadable resources (collectively, the “Website”), operated by Naia Haulani (“Naia Haulani”), a business based in Texas, United States. The Website is intended for adults aged 18 or older. If you do not agree to these Terms, discontinue use of the Website. These Terms do not waive any rights that cannot lawfully be waived, and the enforceability of any provision remains subject to applicable law.

1. Educational Purpose and Scope of Services

The Website provides general education and information concerning nutrition, lifestyle, and well-being. Website content, including the journal Your Cycle, Your Story, does not constitute medical advice, diagnosis, treatment, psychotherapy, or individualized clinical care. Accessing content, downloading a resource, joining a waitlist, or submitting an inquiry does not establish a clinician–patient relationship or a paid coaching relationship.

Medical concerns should be addressed with an appropriately licensed healthcare professional. The Website and its forms are not emergency services and are not monitored for urgent medical needs. Decisions about clinical treatment remain matters for you and your treating healthcare professional.

2. Information and Outcomes

Content is provided for general educational use and may not be appropriate to every individual or circumstance. No particular health, personal, or coaching outcome is promised. Personal accounts describe individual experiences and do not establish that a service will produce the same outcome for another person. Nothing in these Terms excuses inaccurate or misleading advertising or limits any obligation imposed by applicable consumer-protection law.

3. Intellectual Property and Permitted Use

Except where otherwise identified, original text, designs, materials, and downloadable resources are owned by Naia Haulani or used with authorization. Third-party materials and trademarks remain the property of their respective owners.

You may view Website content and download or print free resources for your own personal, noncommercial use. This permission does not transfer ownership. Except as permitted by applicable law or express written authorization, you may not sell, republish, distribute, alter for redistribution, or use the materials to create a competing commercial product. Copyright notices and attribution must remain intact. Sharing a link to the Website is permitted.

4. Acceptable Use and Submissions

Do not use the Website for unlawful, fraudulent, harassing, or abusive activity; attempt unauthorized access; interfere with its security or operation; or submit malicious code, spam, or another person’s information without authority.

Website forms are intended for general inquiries and signups. Do not submit medical records, detailed clinical information, or confidential information belonging to another person. Submissions must be accurate to the best of your knowledge. Submitting an inquiry or joining a waitlist does not guarantee acceptance into a program or reserve a paid coaching appointment.

You retain any rights you hold in the content you submit. Submission permits its processing only as described in the applicable privacy notice and as necessary to respond to your request. It does not grant permission to publish your name, message, or testimonial for marketing. Separate permission will be requested for that use.

5. Privacy and Communications

Personal information is handled as described in the Privacy Policy and, where relevant, the Consumer Health Data Privacy Policy. These Terms do not replace any separate consent required by law for marketing, tracking, or the collection or sharing of health information. An inquiry or resource request does not itself constitute consent to unrelated marketing.

6. External Services and Links

The Website links to independent services, including email signup platforms and social media. Those services have their own terms and privacy notices. A link does not constitute an endorsement of all third-party content or practices. Naia Haulani does not control independent third-party services; this statement does not exclude responsibility for Naia Haulani’s own selection, instructions, disclosures, or other conduct where applicable law imposes that responsibility.

7. Availability and Warranties

Reasonable efforts are made to maintain accurate and accessible Website information, but content may contain errors or become outdated. The Website may be updated, interrupted, or unavailable. To the extent permitted by applicable law, the Website and free resources are provided “as is” and “as available,” without warranties of uninterrupted availability or suitability for a particular purpose. This provision does not exclude any express promise, statutory warranty, or other protection that cannot lawfully be excluded.

8. Limitation of Liability and Consumer Rights

To the extent permitted by applicable law, Naia Haulani will not be liable for indirect, incidental, special, or consequential loss arising from use of the Website or its free resources. This limitation does not exclude liability for fraud, intentional misconduct, gross negligence, or any liability that cannot lawfully be excluded or limited. Nothing in these Terms requires you to release a valid legal claim, waive a statutory privacy right, or surrender a remedy available under mandatory consumer-protection law.

9. Paid Coaching and Future Transactions

These Terms do not establish the price, scope, duration, cancellation policy, or refund terms for paid coaching. Any future paid engagement will be subject to a separate agreement provided before enrollment or payment. That agreement will address service scope, scheduling, fees, cancellation and refund conditions, confidentiality, and relevant client responsibilities. Joining a waitlist or downloading a free resource creates no payment obligation.

10. Changes and Interpretation

The current version is identified by the last-updated date above. Changes will be published on this page, with additional notice or consent where required. Changes will not retroactively remove accrued rights or alter an existing paid agreement. If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law. These Terms do not impose mandatory arbitration, a class-action waiver, or a shortened statutory claim period.

11. Governing Law and Geographic Scope

These Website Terms are governed by applicable United States federal law and the laws of Texas, except to the extent that mandatory law in your jurisdiction requires otherwise. This provision does not waive privacy, consumer-protection, or other rights that cannot lawfully be waived, require an exclusive Texas forum, or determine the law governing a separate paid coaching agreement. Availability of the Website does not represent that coaching is lawful or available in every jurisdiction. Client location and applicable service requirements must be considered before an engagement is accepted.
